2012 Free Birthday Ticket Program Terms and Conditions

The 2012 Free Birthday Ticket Program (the "Program") is offered at the discretion of Washington Nationals Baseball Club (the "Nationals"). Participation in the Program is subject to these terms and conditions and any other rules, regulations, policies and procedures ("Terms and Conditions") that Nationals may, in its discretion, adopt from time to time. The Nationals has the right to change, limit, modify or cancel the Program at any time, with or without notice. This is a binding agreement. By registering for the Program by submitting the form above you are agreeing to these Terms and Conditions.

I. ELIGIBLE PARTICIPANTS & REGISTRATION: All Nationals fans who are eighteen (18) years of age or older at the time of registration are eligible to participate in the Program (each a "Participant"). Limit of one (1) registration per Participant. To register for the Program, Participants must complete and submit the registration form located above by no later than 11:59 p.m. ET the night before the Eligible Game (defined below) he/she would like to attend. In the case of multiple registrations for the same e-mail address, only the first registration received will be considered, except that parents or legal guardians of minor children may register for themselves and on behalf of their minor children as set forth below. Upon successful registration, Participant will be sent a voucher via email to the email address provided in the registration form (the "Email Voucher"). If Participant does not receive his/her E-mail Voucher within two (2) hours after registration, he/she should contact the Nationals at Ticket.Info@nationals.com. Each Email Voucher may be redeemed for one (1) FREE Upper Right Field Terrace admission ticket to an Eligible Game (each a "Ticket"), subject to availability at the time of redemption. If there are no seats available in the Upper Right Field Terrace section at the time of redemption, Participant may redeem an Email Voucher for one (1) FREE Lower Right Field Terrace admission ticket to the Eligible Game (such tickets to be included in definition of "Ticket"). If there are no seats available in the Upper Right Field Terrace or Lower Right Field Terrace sections, and either no upgrades (as described below) are available or Participant chooses not to purchase an upgrade, Participant will not be able to redeem his/her Email Voucher for the applicable Eligible Game and must bring his/her Email Voucher back to a remaining Eligible Game for redemption.

II. REGISTRATION OF CHILDREN: A Participant who is a parent or legal guardian of a minor child may submit the registration form once to register themselves and then submit it again, with applicable "Child Birthday Celebrant Information" completed, to register each one of his/her minor children in celebration of each registered minor child's birthday. Each Email Voucher received on behalf of a minor child may be redeemed for one (1) FREE Upper Right Field Terrace companion ticket to an Eligible Game (each a "Companion Ticket"). If there are no seats available in the Upper Right Field Terrace section at the time of redemption, Participant may redeem an Email Voucher on behalf of his/her minor child for one (1) FREE Lower Right Field Terrace admission ticket to the Eligible Game (such tickets to be included in definition of "Companion Ticket").

III. REDEEMING EMAIL VOUCHERS: Participant must print his/her Email Voucher and redeem it at the Main Box Office at Nationals Park (located to the left of the Centerfield Gate) on the day of Eligible Game that Participant would like to attend. PLEASE NOTE THAT TICKETS WILL NOT BE MAILED AND CANNOT BE PICKED UP IN ADVANCE. EMAIL VOUCHERS MUST BE REDEEMED NO LATER THAN THIRTY (30) MINUTES AFTER THE FIRST PITCH OF AN ELIGIBLE GAME. When redeeming Email Vouchers at the Main Box Office, Participants will be asked for a valid photo ID matching the name and birthday provided at registration and, upon verification will receive their Ticket, if such Ticket is available. Participants must present a separate, printed E-mail Voucher for each redemption, including redemption for Companion Tickets. To redeem an Email Voucher for a Companion Ticket at an Eligible Game, the Participant who registered his/her Child Participant must accompany their child to the Nationals Park Main Box Office on the day of an Eligible Game with a printout of the Email Voucher and acceptable photo ID. Child Participants are not required to submit proof of birthday but the Participant who is their parent/legal guardian must provide a valid photo ID matching the name provided when they registered the Child Participant. PLEASE NOTE: To redeem an Email Voucher for a Companion Ticket, the Participant must hold or purchase a valid ticket immediately adjacent to the Companion Ticket for the applicable Eligible Game, and must sit with his/her Child Participant for the duration of the Eligible Game. When redeeming an Email Voucher for a Companion Ticket, the applicable Participant may (at the sole discretion of the Washington Nationals) be allowed to exchange a previously purchased ticket of equal or greater value to sit with his/her Child Participant, but Participant shall not be entitled to any refund or credit for such exchange. Participant may (at the sole discretion of the Washington Nationals) be allowed to exchange a previously purchased ticket of lesser value to sit with his/her Child Participant, but Participant shall be required to pay the difference at the time of the exchange.

All Tickets and Companion Tickets are subject to availability. There is no guarantee that an E-mail Voucher will be redeemable for a Ticket or Companion Ticket to any particular Eligible Game. If there are not enough Tickets or Companion Tickets to seat a Participant (with his/her Child Participant, if applicable) at the Eligible Game Participant has selected, Participant will need to bring his/her and/or his/her Child Participant's Email Voucher(s) back to a remaining Eligible Game. A Nationals Main Box Office representative will assist Participants in determining what, if any, Tickets and Companion Tickets are available when presented with an E-mail Voucher.

IV. ELIGIBLE GAMES: Participants may only redeem Email Vouchers for Tickets and Companion Tickets to 2012 regular season home games designated by the Nationals as "Regular" or "Value" at nationals.com/seating during the applicable month(s) set forth below based on the Participant or Child Participant's, as applicable, birthday (each an "Eligible Game"):

• If the applicable Participant or Child Participant birthday registered falls in January, February, March, the Email Voucher may be redeemed for a Ticket or Companion Ticket (as applicable) for any Eligible Game in April or September.
• If the applicable Participant or Child Participant birthday registered falls in April, May, June, July or August, the Email Voucher may be redeemed for a Ticket or Companion Ticket (as applicable) for any Eligible Game during the birth month or September.
• If the applicable Participant or Child Participant birthday registered falls in September, October, November or December, the Email Voucher may be redeemed for a Ticket or Companion Ticket (as applicable) for any Eligible Game in September.

The last Eligible Game is scheduled for 1:05 p.m. ET on September 24, 2012, therefore all registrations must take place prior to the final deadline of 11:59 p.m. ET on September 23, 2012. For the avoidance of doubt, the following 2012 home games are designated by the Nationals as "Prime" or "Marquee" home games and are not Eligible Games: April 12, May 4, 5, 6, 18, 19 and 20, June 2, 15, 16 and 17, July 4, 20, 21 and 31 and August 1, 2, 17 and 18. Home games scheduled for October 1, 2 and 3 are also not Eligible Games.

PLEASE NOTE: Participant may still register even after his/her (or his/her minor child's) birthday month has passed, and redeem his/her (or his/her minor child's) Email Voucher for an Eligible Game in September (or in April, for those Participants whose birthday falls in January, February or March).

V. UPGRADES: Availability permitting, Participants may have the option of upgrading Tickets and Companion Tickets to the Upper Infield Gallery, LF/RF Mezzanine, or LF/RF Corner seating section (as such sections are set forth at www.nationals.com/seating ) for an additional fee, payable at the time of redemption of each Email Voucher. The additional fee to upgrade a Ticket or Companion Ticket to the Upper Infield Gallery is $5.00, to the LF/RF Mezzanine is $10.00, and to the LF/RF Corner is $15.00. A Nationals Main Box Office representative will assist Participants in determining what, if any, upgrades are available when an Email Voucher is presented for redemption to an Eligible Game. REMEMBER: To redeem an Email Voucher for a upgraded Companion Ticket, the Participant must hold or purchase a valid ticket immediately adjacent to the upgraded Companion Ticket for the applicable Eligible Game and must sit with his/her Child Participant for the duration of the Eligible Game.

VI. GENERAL PROVISIONS:

1. Registrations generated by a script, macro, or other mechanical or automated means will not be valid. Please be sure to provide an accurate e-mail address. Neither MLB Advanced Media, L.P. nor the Nationals are responsible for any e-mails, including those delivering an Email Voucher, which are bounced back or misdirected.
2. Participants may be given the option to receive commercial e-mail from nationals.com and/or MLB.com; however, eligibility to participate in the Program is not dependent upon consent to receive such e-mail.
3. NOTE: MLB game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Nationals, as applicable, and may be subject to change. All Tickets and Companion Tickets obtained in connection with this Program shall be subject to those policies applicable to Nationals ticket holders generally.
4. Email Vouchers may be redeemed for Tickets and Companion Tickets to Eligible Games in accordance with these Term and Conditions only. No credit will be issued for Email Vouchers not redeemed or Tickets or Companion Tickets not used. Email Vouchers, Tickets and Companion Tickets have no cash value.
5. Email Vouchers, Tickets and Companion Tickets cannot be combined with any other ticket offer or ticket discount including, but not limited to, the College Super Saver or Family Fun Pack. Tickets and Companion Tickets cannot be exchanged as part of the Season Ticket Exchange programs.
6. Tickets and Companion Tickets issued for Eligible Games that are rained out, postponed or cancelled for any reason may be used on the rescheduled game/makeup date only. Tickets and Companion Tickets for canceled Eligible Games that are not rescheduled can be exchanged for a Ticket or Companion Ticket (as applicable) to a future Eligible Game. All exchanges must be made at the Nationals Park Main Box Office and are subject to availability.
7. Tickets and Companion Tickets do not include parking.
8. Email Vouchers, Tickets and Companion Tickets cannot be re-sold by any means, electronic or otherwise. The Nationals reserves the right to revoke and not honor any Email Vouchers, Tickets or Companion Tickets that have been resold.
9. In the case of fraud or abuse involving the Program, the Nationals shall have the right to take appropriate administrative and/or legal action, including, but not limited to, revocation/cancellation of Email Vouchers, Tickets and Companion Tickets.
10. The awarding of Email Vouchers, Tickets and Companion Tickets is void where prohibited by law.
11. Participants may not use any Email Vouchers, Tickets or Companion Tickets obtained in connection with this Program for any promotional purposes whatsoever.
12. Participants and their guests shall at all times maintain proper decorum while attending games at Nationals Park, and will abide by all applicable governmental laws, ordinances, orders, directions, rules and regulations, as well as all rules and regulations as are adopted and revised from time to time by the Nationals or any of its affiliates. The Nationals reserves the right to exclude or eject any and all unruly, rowdy or disruptive persons from Nationals Park without liability and the applicable Participant shall be fully responsible for any damages or expenses, direct or indirect, incurred by the Nationals and its affiliates as a result of such disruptive behavior and/or ejection.
13. This Program shall be governed by the internal laws of the District of Columbia, without regard to its conflicts of laws, rules or policies. The Nationals and each Participant agree that any dispute, claim or controversy arising from or relating to this agreement or participation in the Program shall be resolved by binding arbitration conducted in the District of Columbia. The parties acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim or controversy. The parties understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration under this agreement shall be consolidated with any other arbitration. Awards are offered in good faith, however they may not be available if prohibited or restricted by applicable law or regulation in the United States of America. If any part of these Terms and Conditions is held to be unlawful or unenforceable, that part will be deemed deleted from these Terms and Conditions in such jurisdiction and the remaining provisions will remain in force. All disputes which cannot be resolved between the parties, and causes of action arising out of or connected with the Program shall be resolved individually, without resort to any form of class action.
14. BY PARTICIPATING IN THE PROGRAM, THE PARTICIPANT AGREES (ON BEHALF OF HIS OR HER MINOR CHILD, IF APPLICABLE) THAT THE NATIONALS AND ITS AFFILIATES AND, SUBSIDIARIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE "RELEASED PARTIES") WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY MEMBERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE OR EXEMPLARY DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF AN EMAIL VOUCHER, TICKET OR COMPANION TICKET, OR PARTICIPATING IN THE PROGRAM OR PROGRAM-RELATED ACTIVITY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY EMAIL VOUCHER CANNOT BE REDEEMED AND/OR IF TICKETS OR COMPANION TICKETS ARE NOT ABLE TO BE USED. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO ANY PARTICIPANT FOR ANY DELAY IN OR FAILURE TO PERFORM DUE TO CAUSES BEYOND THEIR CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, ACT OF WAR, NATURAL DISASTER, STRIKE, WEATHER, TERRORISM, OR ANY ACT OR OMISSION OF A THIRD PARTY. THIS SECTION WILL SURVIVE TERMINATION OF PARTICIPANT’S PARTICIPATION IN THE PROGRAM.
